By accessing or using the RigInsure website, services, and platform (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. RigInsure reserves the right to update these Terms at any time, and your continued use constitutes acceptance of any changes.
2. Description of Service
RigInsure provides a platform for commercial trucking insurance quotes, lead management, and related services. We connect prospective policyholders with licensed insurance agents and agencies. RigInsure is not an insurance company and does not underwrite policies. All insurance products are provided by third-party carriers.
3. User Accounts
Certain features require account registration. You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate, current, and complete information during registration and to update such information as needed. You are responsible for all activities that occur under your account.
4. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding your personal information.
5. SMS/Text Messaging
By opting in to receive SMS/text messages from RigInsure, you consent to receive recurring automated text messages at the phone number you provided, including but not limited to: appointment reminders, agent call notifications, follow-up messages, and promotional or marketing messages. Message frequency varies. Message and data rates may apply. You may opt out at any time by replying STOP to any message. For help, reply HELP or contact us at support@riginsure.io. Consent to receive text messages is not a condition of purchasing any goods or services. Carriers are not liable for delayed or undelivered messages.
6. Prohibited Conduct
You agree not to: (a) use the Service for any unlawful purpose; (b) submit false, misleading, or fraudulent information; (c) interfere with or disrupt the Service; (d) attempt to gain unauthorized access to any portion of the Service; (e) scrape, harvest, or collect data from the Service without authorization; or (f) impersonate any person or entity.
7. Intellectual Property
All content, trademarks, logos, and intellectual property displayed on the Service are the property of RigInsure or its licensors. You may not reproduce, distribute, modify, or create derivative works from any content without prior written consent.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. RIGINSURE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, RIGINSURE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in the State of Texas.
